Contact points under the Digital Services Act (DSA)

We receive notifications and official requests under Regulation (EU) 2022/2065 (Digital Services Act – “DSA”) in a structured manner, review them without undue delay, and provide transparent information about the measures taken. Communication is possible in German and English.

Contact point for authorities (Art. 11 DSA)

Purpose: To receive reports from courts/authorities, other public bodies and Trusted Flaggers (accredited whistleblowers) regarding illegal content or user information.

Information required for an effective request

  • Responsible authority, legal basis and file number
  • Details: exact URL(s)/Content ID(s), affected accounts, timestamps
  • Justification of the illegality, including relevant legal provisions where applicable.
  • Desired action (e.g. removal, geoblocking, data release) and deadline
  • Proof of authenticity (qualified signature, official letterhead, secure delivery)
  • For data requests: scope, purpose, legal basis, demonstration of proportionality

Upon receipt, we verify authenticity and jurisdiction, secure necessary evidence, implement appropriate measures and report the outcome in a timely manner.

Contact point for users and other reporting parties (Art. 12, 16 DSA)

Purpose: Reporting potentially illegal content (reviews, shop offers, profile information, media).

Information required for an effective request

In order for us to act quickly, your report needs:

  • Exact URL(s) or Content ID(s); for apps: clear navigation paths/screenshots
  • Description of why the content is allegedly unlawful; legal norm (if possible)
  • Evidence (screenshots, timestamps, context)
  • Contact address for follow-up questions (optional, but recommended)
  • Confirmation of the accuracy of your information ("to the best of my knowledge and belief")

What happens next?

  • Confirmation of receipt (automatic, if contact details are provided)
  • Factual review by moderation/legal review
  • Action: Removal/hiding/geoblocking, restriction of functions, obtaining further information or rejecting the report
  • Notification of the decision including the reasons (“Statement of Reasons” pursuant to Art. 17 DSA), if available

Please note:

  • Anonymous reports are possible; a lack of contact options may prevent follow-up questions/feedback.
  • Obviously abusive or massively identical unsubstantiated reports may be rejected and channels restricted.

Internal grievance procedure and out-of-court dispute resolution (Articles 20–21 DSA)

Those affected who disagree with our content-related decision may file a free internal appeal within six months. This can be done by emailing appeals@sexbutler.de (subject: "DSA Appeal" and case ID). The appeal will be reviewed by a different body than the one that made the initial decision ("second look") and will lead to a new decision. Regardless of this, it is also possible to contact an EU-approved out-of-court dispute resolution body pursuant to Article 21 of the DSA; its decision is not automatically binding, but will be carefully considered. The right to legal recourse remains unaffected in all cases.

Service of process, place of business and legal representative (Art. 13 DSA)

We are established in the European Union; therefore, a separate legal representative pursuant to Article 13(2) GDPR is not required. Legal inquiries should be directed to team@sexbutler.de or to the postal address listed in the legal notice.

Transparency, documentation and retention (Articles 15, 17 and 24 DSA)

We regularly publish transparency reports with aggregated key figures on reports and moderation measures, including the number and type of submissions, processing times, and success rates of complaints. For content-related measures, we prepare reasoned notifications in accordance with Article 17 of the GDPR. We generally retain procedural documents and evidence for twelve months after conclusion of the proceedings, or longer if required by legal obligations, regulatory requirements, or legitimate interests in enforcing or defending our rights. Personal data is processed in accordance with our privacy policy; the relevant legal bases are, in particular, Article 6(1)(c) GDPR for legal obligations and Article 6(1)(f) GDPR for legitimate interests. Access is role-based and logged.

Requirements for the quality of reports

Reports should be precise, verifiable, and substantive. General statements without specific identification of the content are insufficient. Rights holders should provide proof of their authorization; in cases involving personal or data protection information, the affected data and the reason for the infringement must be described. The more precise and substantiated a report is, the faster we can review it.

Measures in case of violations

Depending on the severity and obviousness of the issue, content may be removed, hidden, geoblocked, de-indexed, or downgraded. Additionally, functional restrictions, warnings, and temporary or permanent account suspensions may be imposed. In legally mandated cases, we will inform the relevant authorities. Decisions are based on our terms and conditions, as well as applicable law, and are documented and justified.

Abuse prevention and prioritization

To protect reporting channels, we employ technical and organizational measures such as rate limits, CAPTCHAs, and abuse warnings. Cases involving dangerous situations, official orders, and reports from accredited trusted flaggers are prioritized. Obviously abusive or massively identical reports without substantiation may be rejected, and channels may be restricted.

Shops and merchant content in the DSA context

Reports of illegal goods, misleading product information, or missing mandatory information in merchant shops are reviewed using the same procedure. In cases of clear or repeated violations, listings may be removed without prior notice, and affected shops may be temporarily or permanently suspended; merchants will be informed and can use the complaint procedure.

Technical submission and confidentiality

For extensive documents, we provide a secure upload option upon request. Confidential content can be marked as such; we will then review whether restricted access is necessary. To ensure integrity, we add checksums to critical files and maintain traceable audit trails.

Languages, deadlines and availability

We generally acknowledge reports automatically and process them without undue delay. Official deadlines take precedence; otherwise, we consider the complexity of the case. Communication is possible in German and English; urgent cases received outside of service hours will be prioritized as soon as possible.
